These Terms of Service ("Terms") govern your access to and use of the website located at senditmedia.fyi (the "Site") and any website design, hosting facilitation, search engine optimization, advertising management, booking, review-automation, or related services (collectively, the "Services") provided by Send It Media LLC, a Delaware limited liability company ("Send It Media," "we," "us," or "our"). By accessing the Site, engaging our Services, or clicking "I agree" on any proposal or invoice, you ("Client," "you," or "your") agree to be bound by these Terms.
By using the Site or engaging Send It Media for any Service, you confirm that you are at least 18 years old, have the authority to bind the business you represent (if applicable), and agree to these Terms in full. If you do not agree, do not use the Site or engage our Services.
Send It Media provides done-for-you website design, publishing, and hosting facilitation, along with optional add-on services that may include an AI-powered receptionist, automated review requests, local search (SEO) optimization, online booking integration, paid advertising management, and periodic content refreshes ("Add-On Services"). The specific scope, deliverables, and timeline for your engagement will be described in a proposal, order form, invoice, or written communication ("Order"). In the event of a conflict between an Order and these Terms, the Order controls for that engagement.

Fees for Services are set out in your Order and are billed and collected through our third-party payment processor, Stripe. Invoices are due upon receipt unless otherwise stated in your Order. We do not store your full payment card details; payment information is collected and processed directly by Stripe subject to Stripe's own terms and privacy practices.
Unless otherwise agreed in writing, fees for work already performed (including design, development, and setup work) are non-refundable once delivered. Recurring or subscription-based Add-On Services may be canceled at any time effective at the end of the current billing period, but we do not provide partial-period refunds except where required by law.
Upon full payment for a website build, Send It Media assigns to you ownership of the final website design and content created specifically for your project, excluding any pre-existing tools, templates, code libraries, or proprietary automation systems we use to deliver the Services, which remain our property (or that of our licensors) and are licensed to you for use solely in connection with your website. We may reference completed client work, including screenshots of your website, in our portfolio and marketing materials unless you notify us in writing that you'd prefer we not do so.
Delivery of the Services may rely on third-party platforms, including but not limited to Cloudflare (hosting and email routing), Stripe (payment processing), and various search, advertising, and analytics providers. These third parties operate under their own terms and are not controlled by Send It Media. We are not responsible for outages, data loss, policy changes, or service interruptions caused by third-party providers.
THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not guarantee any specific search ranking, volume of leads, bookings, revenue, or other business outcome from use of the Services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEND IT MEDIA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE TOTAL FEES YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify and hold harmless Send It Media, its owners, and personnel from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Services, or your violation of these Terms or any applicable law.
Either party may terminate an engagement as set out in the applicable Order, or with 30 days' written notice if no term is specified. We reserve the right to suspend or terminate access to the Site or Services immediately for non-payment or violation of these Terms. Upon termination, outstanding fees for work performed remain due.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Services will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
We may update these Terms from time to time. Material changes will be reflected by an updated "Effective date" at the top of this page. Continued use of the Site or Services after changes take effect constitutes acceptance of the revised Terms.
